1. Acceptance of Terms

By using the services of Cartainer Ocean Line ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services Provided

Cartainer Ocean Line provides international shipping and logistics services, including:

  • Vehicle shipping to Central America, Dominican Republic, and other international destinations
  • Container shipping and freight forwarding services
  • Import and export assistance
  • Customs clearance and documentation services
  • Related logistics and transportation services

3. Customer Responsibilities

As a customer, you agree to:

  • Provide accurate and complete information about your shipment
  • Ensure all items comply with applicable laws and regulations
  • Provide proper documentation (titles, passports, permits, etc.)
  • Pay all fees and charges in accordance with our payment terms
  • Comply with customs and import/export requirements
  • Inspect and accept delivery of your shipment in a timely manner

4. Prohibited Items

The following items are prohibited from shipment:

  • Illegal drugs, narcotics, or controlled substances
  • Weapons, ammunition, or explosives
  • Hazardous materials or dangerous goods (unless properly declared and approved)
  • Stolen or illegally obtained items
  • Items that violate intellectual property rights
  • Perishable goods (unless specifically arranged)
  • Currency, precious metals, or jewelry (unless properly declared)

5. Pricing and Payment

  • All prices are subject to change without notice
  • Payment is due according to the terms specified in your service agreement
  • Additional fees may apply for customs, storage, or special handling
  • Credit card payments may incur a processing fee
  • Unpaid shipments may be subject to storage fees and eventual disposal

6. Delivery and Transit Times

  • Transit times are estimates and not guaranteed
  • Delays may occur due to weather, customs, port congestion, or other factors beyond our control
  • We will make reasonable efforts to notify you of significant delays
  • You are responsible for timely pickup or delivery acceptance

7. Liability and Insurance

Limitation of Liability:

  • Our liability is limited to the declared value of your shipment or $500 per item, whichever is less
  • We are not liable for consequential, indirect, or punitive damages
  • Marine insurance is available for additional coverage (recommended)
  • Claims must be reported within 30 days of delivery or expected delivery date

8. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, labor disputes, government actions, port closures, or pandemic-related restrictions.

9. Customs and Regulations

  • You are responsible for compliance with all applicable customs and import/export laws
  • Additional duties, taxes, or fees imposed by authorities are your responsibility
  • We may assist with customs clearance but do not guarantee approval
  • Shipments may be inspected, delayed, or seized by authorities

10. Vehicle-Specific Terms

For vehicle shipments:

  • Vehicles must be in running condition unless otherwise arranged
  • Remove all personal items from vehicles before shipment
  • Fuel tanks should be no more than 1/4 full
  • Provide clear title and proper documentation
  • Vehicle condition will be documented before and after transport

11. Container-Specific Terms

For container shipments:

  • Accurate packing lists and item descriptions are required
  • Proper packing and securing of items is your responsibility
  • Container sharing may be arranged to reduce costs
  • Access to containers may be limited during transit

12. Dispute Resolution

  • Any disputes will be resolved through binding arbitration
  • Arbitration will be conducted in accordance with applicable commercial arbitration rules
  • The prevailing party may be entitled to attorney's fees and costs
  • Class action lawsuits are waived

13. Privacy and Data Protection

Your personal information is handled according to our Privacy Policy. By using our services, you consent to the collection, use, and sharing of information as described in our Privacy Policy.

14. Modifications

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified terms.

15. Severability

If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will remain in full force and effect.

16. Governing Law

These Terms and Conditions are governed by the laws of the United States and the state in which our principal place of business is located.
